Kaysun Corporation (hereinafter, collectively, “Kaysun”, “we,” “us,” or “our”) has created this privacy statement (“Privacy Notice”) for the users of our website (“you” or “your”) and to demonstrate our firm commitment to your privacy.

This Privacy Notice describes the information collected, used, and disclosed by Kaysun through our website that links to this Privacy Notice (collectively, “Sites”). This Privacy Notice describes how we treat personal information we collect from the Sites and through our offline interactions with you.  For individuals who reside in the State of California, including applicants within the State of California, please see Appendix A for additional rights and disclosures that may apply to you. 

This Privacy Notice does not apply to third-party websites to which our Sites may link.

Collection of Your Personal Information

Information you provide to us. We may collect personal information about you when you provide it to us or while using or interacting with the Sites. 

We may collect the following categories of personal information when you provide it to us:

  • Identifiers. This may include a name, email address, phone number, location data, online identifier, or other similar identifiers.
  • Commercial information. This may include company name and job title.
  • Internet and network information. This may include information on your interaction with the Sites, or advertisement, such as browsing history and how you use your account.
  • Inferences about you. This may include information about your preferences, characteristics, predispositions, behavior, or other trends that help us identify which products or services you may be interested in.
  • Account Information. This may include your username and password for an account with us.
  • Communications. This may include the contents of your telephone conversations, email communications, etc.
  • Financial information. This may include information pertaining to your payment details.

Further, if you are seeking employment with Kaysun, we may collect the following additional categories of information from our applicants:

  • Government Identifiers of Job Applicants. This may include the last four digits of your Social Security Number.
  • Educational and professional information. This may include work history, educational history, personal and work preferences, criminal history, and any other information you may voluntarily disclose on your application or resume.
  • Demographic information. This may include date of birth, gender, preferred language, marital status, veteran status, disability status, ethnicity, and nationality.

We may also receive personal information that you send us through messages or content you submit when you use the Sites, including when you ask questions, discuss your concerns, report issues, or other related purposes. If you choose to respond to a survey we conduct, we will collect your responses.

Information we collect automatically. As you use the Sites, we may use technologies, such as cookies, that collect certain information about you automatically. We may collect, among other things, your IP address, location, device type, date and time of visit, operating system, browser type and version, activities on the Sites, and information about how you use the Sites. If you are visiting the Sites via a mobile device, we may also collect your mobile device’s unique device ID and information about how you use the Sites. Information we receive from other sources. From time to time, we may also receive information about you from our third-party service providers, affiliates, customers, and partners, including our marketing, conference, and advertising partners and social media networks. We may also receive information from third-party analytics on the Sites that allows us to improve our Sites. Additionally, if you create or log into your account through a social media service account, we will have access to certain information from that account, such as your name and other account information, in accordance with the authorization procedures set by that social media service.

We may also collect information about you from publicly available sources.

Use of Your Personal Information

The personal information that you provide to Kaysun may be stored, processed, and used by Kaysun and its affiliates for the following purposes: 

  • To provide, develop, improve, repair, and maintain our products and services
  • To fulfill your requests and process your transactions, to the extent applicable
  • To provide you with information that you request from us, including updates, notifications, and details of any offers or promotions
  • To personalize, advertise, and market our products and services

  • To maintain our property and our records, and undertake quality and safety assurance measures

Disclosing Your Information with Third Parties

We may Disclose your information with third parties as follows:

  • With service providers that assist us in providing services offered through the Sites, including, but not limited to, services related to technical maintenance, database management, or advertising and marketing research

  • To enforce or protect the terms of our services, rights, property, safety, or that of our users or third parties

Use of Cookies

Kaysun uses cookies to help us provide better customer service, enhance the user experience, and deliver personalized content. A “cookie” is a small text file stored locally in the computer used to access the Sites and contains information relating to your past use of the Sites. Many improvements and updates to the Sites are based on the data collected through cookies, such as total number of visitors and pages viewed. Your Choices

Opt-Out. You may opt out of receiving future marketing communications from us at any time. Security of Information

To protect the privacy of personal information provided by you, Kaysun has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. We urge you to take every precaution to protect your personal information when you are on the internet. Although we will take reasonable efforts to protect your personal information, we cannot guarantee the security of such information transmitted to the Sites. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Sites.

Links to other Websites

The Sites may provide links to other websites. When you choose to use a link to visit another website, you are then subject to the security and privacy policy of that website. We are not responsible for the privacy, security, accuracy, or reliability of the information on third-party websites. You access such links at your own risk. We recommend you read the privacy policy of a website before disclosing any of your information. Links to third-party websites do not imply an affiliation between us and the website owner, or any endorsement, approval, or verification of any content contained on those websites.

Children Under the Age of 18

We do not knowingly collect personal information from children under 18 without parental consent. In the event that we learn that we have collected personal information from a child under the age of 18 without parental consent, we will delete that information and otherwise comply with the requirements of any applicable law including the Children’s Online Privacy Protection Act. If you believe someone under the age of 18 has provided us with personal information, we ask that you contact us through the methods described below.

Any changes to our Privacy Notice will be posted here so that visitors will always know what information we gather, how we might use that information, and whether we will disclose it to anyone. Appendix A: Privacy Information for California Residents 

This Appendix applies solely to individuals who reside in the State of California (“consumers” or “you”). This Appendix complies with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, the “CCPA”) and any terms defined in the CCPA have the same meaning when used in this Appendix. This Appendix does not apply to personal information outside of the scope of the CCPA.

Sources of Personal Information

We collect personal information from:

  • Our interactions with you, such as through our Sites, surveys and questionnaires, emails, social media, and any other online or offline interactions, such as when you contact us via phone or attend one of our events; and
  • Our affiliates, publicly available online sources, and business partners.

Sensitive Personal Information

Sensitive Personal Information consists of: (1) government identifiers, such as Social Security Numbers and drivers’ license numbers; (2) account log-in information (e.g., financial account or credit card numbers in combination with any required access codes or passwords); (3) precise geolocation information; (4) racial or ethnic origin, religious or philosophical beliefs, or union membership; (5) content of postal mail, email, and text messages, unless the business is the intended recipient of the subject communications; (6) genetic data; and (7) biometric information that uniquely identifies a consumer or information concerning a consumer’s health, sex life, or sexual orientation.  To the extent we collect information that is considered Sensitive Personal Information under CCPA, it is listed in the chart above. 

Sale and Sharing of Personal Information

We do not sell and have not sold Personal Information, including your Sensitive Personal Information, in the preceding 12 months.  Without limiting the foregoing, we do not sell the personal information, including the Sensitive Personal Information, of minors under 16 years of age. To ensure we can share our services with you and tailor our advertisements, we do allow some of our advertising partners to use cookies, pixels, and other technologies to collect personal information on our Sites or services, which may constitute Sharing under CCPA. In the past 12 months, we have Shared the following information with our advertising partners:

To the extent you direct us to disclose personal information to third parties, such disclosure does not constitute “Sharing” or “selling.”

In addition, some browsers offer you the ability to opt out of the sharing of your personal information by turning on a Global Privacy Control. You can turn on a Global Privacy Control in your web browser or browser extension or by visiting https://globalprivacycontrol.org/. Please see the California Privacy Protection Agency’s website at https://oag.ca.gov/privacy/ccpa for more information on valid Global Privacy Controls. At this time, we endeavor to respond to browser-based opt-out signals sent through the Global Privacy Control.

Retention Period

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was collected.  The criteria used to determine our retention periods include: 

  • The length of time we have an ongoing relationship with you and provide services to you (for example, for as long as you have an account with us or keep using our services) and the length of time thereafter during which we may have a legitimate need to reference your personal information to address issues that may arise
  • Whether you agree to a longer retention period
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them)
  • Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations)

Further, as it relates to job applicant information, such information is discarded two (2) years following the date the application was processed. 

Individual Rights and Requests

The CCPA provides California residents with specific rights regarding their personal information. In certain circumstances, you may have the following rights:

  1. Right to Know. You may request that we disclose certain information to you about its collection and use of your personal information, including:
    • The categories of personal information we collected about you and the categories of sources from which we collected such personal information
    • The specific pieces of personal information we have collected about you
    • Whether we have sold or shared any your personal information
    • The categories of personal information about you that we “shared” for purposes of cross-context behavioral advertising and the categories of third parties with whom we “shared” such personal information
    • The business or commercial purpose for collecting or sharing personal information about you
    • The categories of third parties to whom we disclosed such personal information (if applicable)
  2. Right to Request Deletion: You may have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.
  3. The Right to Correct: You may have the right to correct inaccurate personal information that we maintain about you.
  4. The Right to Opt-Out of the Sale or Sharing of Your Personal Information:  You may have the right to direct us not to sell personal information we have collected about you to third parties. 
  5. The Right to Non-Discrimination: You may have the right not to receive discriminatory treatment for exercising these rights.
  6. The Right to Appeal: You may have the right to appeal a decision we may make related to your request. To the extent you have a right to appeal a decision we’ve made about your personal information, please submit an appeal request to kaysunprivacy@kaysun.com.
  7. The Right to Limited Use and Disclosure of Sensitive Personal Information: You may have the right to limit the use or sharing of your sensitive personal information.
  8. “Shine the Light”: California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to a third party for the third party's direct marketing purposes.

Exercising Your Rights

To exercise your rights, please contact us at the methods provided below.

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information.  You may also make a verifiable consumer request on behalf of your minor child.  If you are making a request on behalf of another person, you must provide written legal documentation that you are authorized to act on behalf of that individual. 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.  The verifiable consumer request must:

  1. Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative
  2. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it

We may not be able to fulfill your request or provide you with Personal Information if it cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.  To verify your identity, we may request up to three pieces of Personal Information about you, and we reserve the right to take additional steps as necessary to verify your identity if it has reason to believe a request is fraudulent.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt.  If we require more time (up to 90 days), it will inform you of the reason and extension period in writing.  Any disclosures we provide will only cover the 12-month period preceding the date it receives your verifiable consumer request.  The response it provides will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your Personal Information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, it will tell you why it made that decision and provide you with a cost estimate before completing your request. 

Non-Discrimination

You have the right to not be discriminated against for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties
  • Provide you a different level or quality of goods or services
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels.
